Appendix XXI

Use of Student Image, Likeness or Voice

The VCCCD college campuses often host events that are open to the public such as, but not limited to, graduation, athletic competitions, job fairs, speakers, and various activities. These events are considered matters of public interest. Such an event may be photographed, recorded, or livestreamed for purposes of archiving the event, educational use, or publicity. Students, staff, and faculty who attend those events may have their image or voice captured through photography, recording or livestream. Due to the nature of the events, the VCCCD college campuses have no means by which to prevent photography, recording, or livestreaming from capturing a specific student's image or voice. By attending the event or activity, a person is granting the VCCCD college campuses the right to use any photographs, recordings, or livestream captures their image or voice in future publicity, publications, or digital communications without compensation. 
 

Attendance at a public VCCCD event or activity may result in photography, audio recording, video recording, or livestreaming. VCCCD may use photographs, audio recordings, video recordings, and livestream captures of public events for news, educational, archival, and college communications purposes without individual releases when attendees are incidentally captured or appear only as part of an audience, crowd, or group. This provision does not authorize uses that feature an identifiable person, imply endorsement, involve paid advertising, fundraising, merchandise, or disclose student records. In those circumstances, VCCCD will obtain any written consent required by law or District procedure, including the student’s written consent when required by FERPA and parent or legal guardian consent for a minor’s advertising or promotional use where required by California law.
